Terms & Conditions


All bookings are made with Moon Shadow (MS) Website (villa-moonshadow.com) directly; submitting the booking shall be taken as confirmation of acceptance of the following terms and conditions. Moon Shadow reserves the rights to amend/add at its own discretion, anytime and without prior notification.
All guests, who booked Moon Shadow with any other websites or agencies should sign MS Terms and Conditions and send it to Moon Shadow by e-mail ( [email protected]).

1. Bookings

1.1 Provisional Confirmation of Availability and Rates


Upon receipt of a request for availability, the applicable Moon Shadow rates and the amount of deposit required will be confirmed. Bookings are on right of
“The first to have come is the first to be served” basis and are for a minimum of 3 (three) nights or 7 (seven) nights in Peak Season.

1.2 Exclusions & Additional Charges


Rates do not include baggage handling, gratuities, telephone and mobile phone communications,  car rental, motorbikes, food and soft drinks (excluding breakfast on the proposed menu), spirituous liquors, personal items and expenses,
and any excessive cleaning required upon departure (such as upholstery or rug shampooing, etc) or replacement of breakages. Fair wear and tear accepted.

1.3 Rates


Villa rental rates quoted by Moon Shadow are on a per night basis. Check-in time is after 3 PM, with check-out time by 11 AM on the day of departure. Moon Shadow requires a 3 night minimum stay and 7 nights during peak season. Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes.  Rates quoted allow for maximum occupancy of the villa as agreed in advance.
Rates include services of a MS representative: Koh Samui airport shuttle, breakfast, the cost of electricity, water, daily housekeeping, wi-fi,  and so on. Moon Shadow villa is fully equipped with linen, crockery, utensils, and a supply of soap and toiletries, etc.

1.4 Initial Deposit


An initial deposit of 50% of the Villa rental together with the completed Guest Rental/Booking Form and signed Terms and Conditions must be received by Moon Shadow before a confirmation can be issued. No contract will be issued between Moon Shadow and yourself until funds have been received and accepted by Moon Shadow. If funds are not received within 5 banking days the reservation shall be deemed to have been cancelled and Moon Shadow reserves the right to allocate the Villa to another client.
Should the booking be cancelled, cancellation charges will become payable in accordance with the cancellation clause below. Before the booking is confirmed and a contract comes into existence, Moon Shadow reserves the right to increase or decrease the agreed prices. No contract will exist between Moon Shadow and yourself until receipt of funds.

2. Payments


Final payment consisting of the remaining balance must be received by Moon Shadow at least 30 days prior to guest arrival (or 100% together with the Reservation Form if booked less than 30 days in advance of arrival).
Failure to make the final payment on a timely basis will make reservations subject to automatic cancellation and any amount paid will be forfeited. All expenses for money transfer will be charged from the guests. All rates for accommodation are quoted in US Dollar or Thai Baht.

3. Cancellations to reservation


If it becomes necessary to cancel all or any part of the booking, Moon Shadow must be notified in writing (email acceptable). The cancellation will take effect from the day the written confirmation is received. The following cancellation charges will be payable depending on when the notification of the cancellation is received in writing: – More than 30 days before arrival date: The 50% deposit will be forfeited and all other payments will not be refunded, but kept as a credit for 1 year from the date of cancellation as confirmed by Moon Shadow. The credit amount can be used by the client or anyone on their behalf for any reservation, during any period and solely for the villa initially reserved. – Less than 30 days before arrival date: all rental payments (100%) are forfeited.
– In case the deposit was paid and the balance will not be paid, all payments are forfeited with immediate effect and no notification will be issued. – If the dates of the booking need to be changed or amended, this may be treated as a cancellation of the original booking and cancellation charges may apply. – Any change to the original reservation is subject to the approval of Moon Shadow. – Early departure penalty will be applicable as in the other terms for cancellation. Moon Shadow must be notified in writing (email is accepted). The cancellation will take effect from the day the written confirmation is received. All payments are forfeited.

4. Alterations and Cancellations by Moon Shadow Villa


Though it is unlikely that Moon Shadow will have to make any changes to confirmed arrangements, it might happen, and we will advise you at the earliest possible date. If, for any reason beyond our control, we are unable to provide you with the Moon Shadow booking, Moon Shadow shall reserve the right to cancel the reservation.
For example, if the property is damaged or rendered unusable Moon Shadow will cancel the booking and refund you in full, less any bank transfer charges. Moon Shadow shall not be liable for any further obligations or claims by the client.

5. Registered Guests


Please bring photocopies of everyone’s passport with you. Otherwise the villa manager will check your passports and make the copies. Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes. The number of people staying at the property must not exceed the maximum capacity indicated in the webpage.
Should the owner or a MS representative find that the number of people staying at the property exceeds that on the booking form; additional guests will be subject to a person per day surcharge and/or may be asked to vacate. Moon Shadow regrets that no pets are allowed in the property grounds.

6. Security Deposit


A security deposit of US Dollar 1,000 or THB 30,000 will be paid to MS with the payment on Guest arrival. Moon Shadow will not provide any services until security deposit will be paid. This is to cover the cost of any damage or breakages during the rental period of the Villa.
It may also be used to cover the costs of other services.This amount will be returned to you after your departure, less any such costs.

7. Insurance


It is a condition of the booking that the entire party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage). Moon Shadow is not responsible for any and all claims, including any accidents related to the use of the Villa facilities or locally procured third party services such as, watercraft, water sports, car, jeep or motorbike rental etc. As deposits and rental payments are not refundable after a reservation has been confirmed, we highly recommend to buy an all-inclusive travel insurance which covers all your expenses if you have to cancel
your journey, need medical treatment overseas or emergency evacuation, or extra costs because of luggage delay or loss, etc. Moon Shadow shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside Moon Shadow’s control such as civil disturbances, fires, floods, severe weather, acts of God, acts of Government; termination of supply of electricity and water on the Samui island or Moon Shadow area.

8. Liability


Moon Shadow is in no circumstances responsible for any loss, expense, damage, claim or injury either directly or indirectly, consequential or otherwise whatsoever, however caused or incurred, whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted, or by reason of military action, revolution or acts of God, or by any agents, employees, subcontractors, servants or third parties whatsoever supplying any of the services or accommodations herein or as substituted. If any accommodations and/or services are substituted, Moon Shadow will act at all times in good faith and use its best efforts to substitute with accommodations and/or services of a type comparable to or better than those originally contracted. Moon Shadow at their sole and unfettered discretion reserves the right to refuse or discontinue service to any person(s) and/or to rescind any contract for accommodations or guest services without any explanations.
Moon Shadow is not responsible for any deaths and injuries whatsoever within or outside its property, e.g. falls from the terrace, staircases or balconies. Prostitution is not allowed in the whole property of Moon Shadow. Moon Shadow is not responsible or liable for any personal injury or death casualty of accompanying children, whatsoever. Moon Shadow is not suitable for children under 12 years, due to many reasons, e.g. the height of its terraces and its swimming pool which is not guarded and electrical sockets, which don’t have child protection, etc.. Therefore children under 12 years are not allowed to stay in the property of Moon Shadow. If the parents or legal guardians don’t accept this condition they act at their own risk and are solely responsible for the safety of their children. By acceptance of this contract and / or the transfer of the 50% deposit, the client agrees to the disclaimer of liability, written above and, that this requirement has and will be complied with in full extent.

9. Complaints


Each Villa building is to the same overall standard, quality and finish but there are small differences in style and decor. The descriptions provided by Moon Shadow on the website and elsewhere are made in good faith. Moon Shadow accepts no responsibility for any modifications made which are not mentioned here or anywhere else. Moon Shadow does not accept responsibility for the breakdown of the supply of water, or electricity, nor of swimming pool filtration systems, though we will use our best endeavours to arrange for any such problems to be solved quickly. If there are any problems during the rental period, which could not be solved by dealing directly with the local staff, contact the Guest Relations Manager immediately and Moon Shadow will use its best endeavours to rectify the situation. Moon Shadow will do as much as it can be reasonably expected to avoid and rectify any problems that may occur, but cannot be held responsible for any problems. Any complaints must be notified to Moon Shadow within 24 hours of the occurrence giving rise to the complaint.
Should a problem remain unsolved please make an immediate complaint in writing to Moon Shadow before completion of the rental period. If the Villa is vacated before the end of the rental period without mutual agreement this may result in the loss of all rights to compensation. The villa may be close to an ongoing construction site.  Moon Shadow is not responsible and thus not liable for any noise or other disturbance arising out of this. Nonetheless Moon Shadow will do its best to provide for a nice stay of its guests. No complaints will be considered if made after the departure date or if not acknowledged by the villa owner or the villa representative.

10. Conduct & Behaviour


The person signing the contract is responsible for the correct and appropriate behaviour of the guests staying at the Villa. Should any member of the party not behave in such a manner, the owner or Moon Shadow representative may at their absolute discretion ask the offending guest or guests to vacate the Villa forthwith. The whole villa is a non smoking area, except the pool and sun deck areas. It is strictly forbidden to throw away any cigarettes, cigars, lighters or other things, except on devices like ashtrays, after having put out the fire with water. It is specially forbidden to throw anything away outside the handrails and balustrades of the terraces or in the garden.
It is not allowed to sit or lie down on any inside villa furniture being wet or having sun screen on the skin (or any type of cream or oil), which will be in contact with the furniture. It is not allowed to jump into the pool, due to the danger of head injuries or other injuries at the low level area and due to slippery feet. Moon Shadow behavior rules do not allow any kind of discrimination towards villa staff on sex, race and class lines. Otherwise the Villa reserves the right to ask guests to leave. In severe cases, this will be treated as a cancellation of the original booking and no refund can be claimed from either Moon Shadow or the villa owner or the local representative.

11. Social Corporate Responsibility


It is also prohibited to act unlawfully in any way whatsoever and to bring in and/or use/consume any illegal substances. Any offenders will have to face local authorities in such a case. In addition, in line with it’s moral duty and respect for local employees,
as well as for the safety of our valued guests, guests may not bring non registered persons back to the villas under any circumstances. The local representative reserves the right to request anyone to vacate the property at any time.

12. Extra staffs at the villa


The service charge is 10% additional to the villa booking fee. Including in those services is the cooking for in–villa dining and snacks (guests will be charged for food). Extra services such as those of catering for a party and/or drivers can usually be sourced.
Please make a request as soon as possible – Moon Shadow will do its best to provide that services. MS assumes no liability for such contracted staff. The rates for these services will be provided in advance and shall be paid by you as incurred.

13. Linen & Towels


The onsite maid service will make sure to keep the villa clean and tidy. Linen and towels are included in the Villa Service and belong to the villa. These are normally changed every three (3) days. If you require more frequent changes please contact the villa staff manager. Outside high quality laundry service is available for a small service charge and must be paid at the time incurred.
We do appreciate our guests help to conserve water usage and thus preserve the environmental sustainability of the island. Every toilet provides a little shower at the side. Please use it and don’t throw toilet paper or any other objects in the toilet, but in the waste paper basket at the toilet.

14. Valuables


Any valuables left at the property are left at one’s own risk. Neither Moon Shadow nor the owners nor the staffs are responsible for their loss or damage.
Please make sure that no valuables are lying around.

15. Due care and supervision


As part of this agreement guests are required to take care when residing at the villa and be especially watchful of children playing in the gardens, near the entrance of the property, in the staircases, close to the tempered glasses, railing, the pool area and in the pool, all staircases in the villa and at the balconies and terrasses.
Furthermore guests are not permitted to enter the building when still wet from the pool because the floor can be slippery. Damage or injuries arising as a result shall not be the responsibility of Moon Shadow or the villa owner in any way whatsoever.

16. Applicable law


These terms and conditions and any contract to which they apply are governed in all respects under the law of Thailand and any/all the parties fully accept to elect
the Court of Koh Samui, Surat Thani, Thailand as exclusive jurisdiction in case of disputes/litigation.
